Terms and Conditions of Use — Trainink

1. Who we are and scope
Trainink is an application for football (soccer) coaches to create, store and share training exercises and session plans. It is provided by Davide Esteves — Sole Trader (Empresário em Nome Individual, ENI), Tax ID (NIF) 235580007, registered address Praceta Miramar, nº95 - 3A, 2775-670 Carcavelos, Portugal, contact geral@trainink.app ("we").
These Terms govern your use of the app. By creating an account or using Trainink, you accept these Terms and the Privacy Policy. If you disagree, do not use the app.
2. Eligibility and account
- You must be at least 16 years old to use Trainink.
- You need an account (email and password). You are responsible for keeping your password secure and for all activity on your account.
- Each person should have one account. For security and licensing reasons, each account may be active on up to 2 devices at the same time.
- The information you provide at sign-up must be true and current.
3. Licence to use
We grant you a personal, limited, non-exclusive and non-transferable licence to use Trainink in accordance with these Terms. You may not: resell or sublicense the app; attempt unauthorized access; reverse-engineer it (except as permitted by law); or use the app for illegal purposes or in ways that infringe third-party rights.
4. Your content
- The content you create (exercises, sessions, plans, notes) is yours. It remains yours.
- You grant us only the technical licence strictly necessary to operate the service — to store it, sync it across your devices and, if you choose, share it with the coaches you invite. We do not use your content for any other purpose.
- You are responsible for the content you create and share, and for having the right to share it.
- You can export your content at any time (Settings → My Data → Export) and delete it by deleting your account.
5. Shared libraries
The app lets you create shared libraries and invite other coaches, with roles (admin, editor, viewer). The person who invites is responsible for managing members and for sharing only content they have the right to share. Members with edit permission can change shared content.
6. AI features
The AI features (describe an exercise, import from a photo) are experimental assistance. Results are generated automatically and may contain errors or inaccuracies — which is why we always show the result for you to review before saving. We do not guarantee the accuracy of AI results and you should not rely on them without checking. AI use is subject to your consent and your plan's quotas.
7. Plans, subscriptions and payments
- Trainink has a free plan (with limits) and premium subscription plans.
- Subscriptions are purchased and managed through Google Play, which acts as the seller ("Merchant of Record"). Payment and invoicing are handled by the store.
- Subscriptions renew automatically at the end of each period unless cancelled. You can manage or cancel renewal in your store account settings.
- Prices shown in the store include applicable taxes. We may change prices; any change is communicated in advance and only takes effect at the next renewal — you can cancel before it applies.
- Refunds follow the store's policy (Google). As an EU consumer, you may have a 14-day right of withdrawal — exercised through the store (under the law, this right may lapse when access to the digital service starts immediately, with your consent).
- Each plan's limits (e.g. number of seasons, AI quotas) may be adjusted; changes affecting you will be communicated with reasonable notice.
8. Service availability
We strive to keep the app available, but provide it "as is", with no guarantee of uninterrupted operation. Trainink works offline for your local content; syncing, shared libraries and AI need an internet connection and our providers. We may change, suspend or discontinue features, giving notice when changes are significant.
9. Intellectual property
The "Trainink" brand, logo, design and app software are ours (or our licensors') and protected by law. These Terms transfer no rights over them to you, beyond the licence to use in section 3.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect damages, loss of data resulting from factors outside our reasonable control, or sporting decisions made based on the app's content. Nothing in these Terms excludes liabilities that cannot be excluded by law (including consumer rights). We recommend you export your content regularly as a backup.
11. Suspension and termination
You may stop using the app and delete your account at any time (Settings → Account → Delete account). We may suspend or terminate access for an account that seriously violates these Terms or the law, with prior notice where possible.
12. Changes to the Terms
We may update these Terms. When changes are significant, we notify you (by email or in-app) before they take effect. Continuing to use the app after they take effect means you accept the new Terms.
13. Governing law and dispute resolution
These Terms are governed by Portuguese law. As a consumer, you may use alternative consumer dispute resolution and the electronic Complaints Book (livroreclamacoes.pt). For consumer disputes, you may turn to the following Alternative Dispute Resolution (ADR/RAL) entities: Centro de Arbitragem de Conflitos de Consumo de Lisboa (centroarbitragemlisboa.pt) or CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (cniacc.pt). Full list at consumidor.gov.pt.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay fully in force.
These Terms are also available in Portuguese; in case of divergence, the Portuguese version prevails.
