Terms and Conditions of Use — Trainink

1. Who we are and scope

Trainink is an application for football (soccer) coaches to create, store and share training exercises and session plans. It is provided by Davide Esteves — Sole Trader (Empresário em Nome Individual, ENI) ("we"), Tax ID (NIF) 235580007, registered address Avenida do Atlântico 16, 14-8, 1990-019 Lisboa, Portugal, contact geral@trainink.app and phone +351 910 113 678.

These Terms govern your use of the app. By creating an account or using Trainink, you accept these Terms and the Privacy Policy. If you disagree, do not use the app.

3. Licence to use

We grant you a personal, limited, non-exclusive and non-transferable licence to use Trainink in accordance with these Terms. You may not: resell or sublicense the app; attempt unauthorized access; reverse-engineer it (except as permitted by law); or use the app for illegal purposes or in ways that infringe third-party rights.

5. Shared libraries

The app lets you create shared libraries and invite other coaches, with roles (admin, editor, viewer). The person who invites is responsible for managing members and for sharing only content they have the right to share. Members with edit permission can change shared content.

6. AI features

The AI features (describe an exercise, import from a photo) are experimental assistance. Results are generated automatically and may contain errors or inaccuracies — which is why we always show the result for you to review before saving. We do not guarantee the accuracy of AI results and you should not rely on them without checking. AI use is subject to your consent and your plan's quotas. AI results are an assistive tool and do not replace your professional judgement as a coach — you always decide what to save and apply in your training sessions.

8. Service availability

We strive to keep the app available, but we do not guarantee uninterrupted or error-free operation. This does not affect the conformity rights the law grants you as a consumer (Decree-Law 84/2021). Trainink works offline for your local content; syncing, shared libraries and AI need an internet connection and our providers. We may change, suspend or discontinue features, giving notice when changes are significant.

9. Intellectual property

The "Trainink" brand, logo, design and app software are ours (or our licensors') and protected by law. These Terms transfer no rights over them to you, beyond the licence to use in section 3.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect damages, for loss of data resulting from factors outside our reasonable control, or for sporting decisions made based on the app's content. Nothing in these Terms excludes or limits our liability for intent or gross negligence, for harm to life or physical integrity, for the rights the law grants you as a consumer — including the legal guarantee of conformity of digital services (Decree-Law 84/2021) — or any other liability that cannot be excluded or limited by law. We recommend you export your content regularly as a backup.

11. Suspension and termination

You may stop using the app and delete your account at any time (Settings → Account → Delete account). We may suspend or terminate access for an account that seriously violates these Terms or the law, with prior notice where possible.

12. Changes to the Terms

We may update these Terms for legitimate reasons — for example, evolution of the app, legal or security requirements, or changes in our providers. When changes are significant, we notify you (by email or in-app) with reasonable notice before they take effect. If you disagree, you can stop using the app and delete your account before they take effect; continuing to use the app after that date means you accept the new Terms.

13. Governing law and dispute resolution

These Terms are governed by Portuguese law. As a consumer, you may use alternative consumer dispute resolution and the electronic Complaints Book (livroreclamacoes.pt). For consumer disputes, you may turn to the following Alternative Dispute Resolution (ADR/RAL) entities: Centro de Arbitragem de Conflitos de Consumo de Lisboa (centroarbitragemlisboa.pt) or CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (cniacc.pt). Full list at consumidor.gov.pt.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay fully in force.

These Terms are also available in Portuguese; in case of divergence, the Portuguese version prevails.
